The charges against Fabian are related to the tragic death of his dog, Jasper, and the severe starvation of another. Despite the gravity of these offenses, Fabian pleaded guilty to three misdemeanor charges and received a suspended 90-day jail sentence conditional upon completing five years of probation, during which he is prohibited from owning dogs.

NASCAR’s response has been immediate but cautious, with the organization distancing itself from Fabian amidst the unfolding scandal. NASCAR journalist Pockrass stated the organization took the situation seriously and was actively gathering more information. As a result, Fabian was suspended from his role as Cup Series director, a position he held since January 2019, where he oversaw technical integration and ensured compliance with NASCAR’s rules worldwide, when the allegations came to light in 2021.
